These Terms of Use ("Terms") govern your use of the Mark app (the "App"), provided by Mark Pernitsch, operating as northOS (a sole proprietorship) ("we," "us"). By downloading or using Mark, you agree to these Terms. If you don't agree, please don't use the App.

02your license

We grant you a personal, non-exclusive, non-transferable, revocable license to use Mark on Apple devices you own or control, for your own personal, non-commercial use, subject to the App Store Terms of Service.

03your content is yours

Everything you create in Mark — entries, photos, voice memos, notes — belongs to you and is stored in your own iCloud account. We claim no ownership of it and have no access to it. You are responsible for your content and for keeping your device and Apple ID secure.

04acceptable use

Don't use Mark to break the law, infringe others' rights, or attempt to disrupt, reverse-engineer, or misuse the App or Apple's services beyond what the law allows.

05subscriptions & billing

Mark's core daily features are free. Optional Premium features are sold through Apple In-App Purchase, as an auto-renewable subscription or a one-time lifetime purchase:

• Plans & price: Annual ($39.99 USD/year), monthly ($5.99 USD/month), or lifetime ($79.99 USD once — the founders' price, for the first 1,000 lifetime purchases). In Canada: CA$39.99/year, CA$6.99/month or CA$99.99 for life. The App Store shows the price in your currency before you buy. If you subscribed at an earlier price, you keep it for as long as that subscription stays active.
• Free tier: Your data is never deleted. The free plan keeps your whole history, with limits on what you can add (such as photos per moment, rituals and threads); Premium removes those limits and adds features described on the Plans page. If a subscription ends, you return to the free plan and everything you wrote stays readable.
• Renewal: Subscriptions renew automatically at the then-current price unless cancelled at least 24 hours before the end of the current period.
• Billing: Payment is charged to your Apple ID at purchase and at each renewal.
• Managing & cancelling: Manage or cancel anytime in your Apple ID → Subscriptions settings. Cancellation takes effect at the end of the current period.
• Payments: Apple processes all payments. We never receive your payment details.

06no warranty

Mark is provided "as is." We do our best to keep it reliable, but we don't warrant that it will be uninterrupted or error-free. Sync depends on Apple iCloud and your network.

07limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for any loss of data arising from your use of the App. Keep your own backups via iCloud.

08changes

We may update these Terms; we'll revise the date above and note material changes in the App or on this page. Continued use means you accept the updated Terms.

09governing law

These Terms are governed by the laws of the Province of Quebec and the laws of Canada applicable therein, without regard to conflict-of-laws rules.
